What Are The Penalties For A DUI In Pennsylvania?
Pennsylvania law prohibits driving with a blood alcohol content (BAC) of .08% or more. Penalties may include:
For a first offense: You could face up to six months in jail and extensive fines.
For a second offense: Jail time could run from five days to six months with a 12-month license suspension and extensive fines, and you will have to install and maintain an ignition interlock device.
For a third offense: You face anywhere from days to months in jail, a license suspension, and extensive fines, as well as an ignition interlock device.
Penalties are higher for a BAC of .10% or higher. The first three offenses are all misdemeanors, but a fourth offense rises to a felony charge. In addition, under Pennsylvania’s implied consent law, you may refuse to take the chemical test, but you will automatically lose your license from days to months for a first offense.
